These terms apply when an Owner creates, previews or publishes a website with Nowistay Sites (the “Service”). They add to the General Terms and Conditions of Sale and Use (the “GTCU”), which keep applying to everything they do not cover. Capitalized words have the meaning given in the GTCU. If these terms and the GTCU conflict on the Service, these terms prevail.
The Service is provided by Nowistay SAS, 2 place de la Bourse, 33000 Bordeaux, France, RCS Bordeaux 938 031 838, contact hello@nowistay.com (the “Platform”).
The Service builds a direct-booking website for the Owner from the information the Owner already holds in Nowistay (properties, photos, descriptions, guest reviews, booking settings) and from what the Owner adds while creating the website. The website includes the Nowistay booking widget for the Owner’s properties.
The Platform may change the Service’s features to improve it. It tells the Owner at least thirty (30) days in advance of any change that removes a website the Owner relies on, and of the end of the Service; for a paid website, the part of the subscription already paid for the period after the end of the Service is refunded.
Each Owner account can generate one first version of a website free of charge. Generating it again after deleting the website is not free. The Platform may refuse or stop a generation that breaches section 7.
The first version is shown on a private preview address that is not listed by search engines. The preview is kept for 30 days from its first publication on that address. Without a website subscription at the end of that period, the preview is removed; the website’s content stays in the Owner’s account. Publishing the website on its public address requires a website subscription, offered separately.
The Owner is the publisher of the website: the Owner decides what it shows and is responsible for all its content, including the legal pages (legal notice, privacy policy, booking terms). These pages must meet the law that applies to the Owner and to the guests the website addresses; the Platform provides factual blocks and example texts but no legal advice.
The Platform acts as the hosting provider of the website within the meaning of the applicable law (in particular article 6 of the French law n° 2004-575 of 21 June 2004 and the EU Digital Services Act). It does not check the content before it goes online and is not responsible for it, without prejudice to section 8.
The texts of a website (descriptions, headings, page copy and their translations) are drafted automatically from the Owner’s data. They are generated at the Owner’s request, from the Owner’s data and instructions. They may contain errors. The Owner reads and corrects them before publishing, and remains responsible for them once published. No website is made public without an explicit action by the Owner, who approves its content before publication.
The Service is designed to keep certain content out of automatic writing: prices, availability, capacity and other property facts come from the Owner’s data in Nowistay; guest reviews are shown word for word with their source and date; legal pages are never written automatically. These protections do not replace the Owner’s own review.
The Owner guarantees that they hold the rights needed to use, on the website, every photo, logo, text and other element they upload or import (including photos and texts imported from a listing on a booking platform), and that their use does not infringe anyone’s rights (copyright, image rights, trademarks, privacy).
Guest reviews are shown only as they were written on their original platform, with the guest’s first name, the month and the source. The Owner does not alter them and does not add reviews that were not written by real guests.
The Owner grants the Platform, for the duration of the Service, a free, non-exclusive right to host, reproduce, resize, adapt the format of and display this content, worldwide, for the sole purpose of providing the Service.
The Owner indemnifies the Platform against any claim by a third party relating to content the Owner provided or published.
The Owner may not use the Service to publish:
- content that is illegal, discriminatory, hateful, violent or that harms minors;
- misleading information, in particular invented reviews, ratings or awards, amenities a property does not have, or prices that are not the real prices;
- content that infringes the rights of others, or uses the name or brand of another company (including in the website’s address) without the right to do so;
- personal data of guests or other third parties, access codes, Wi-Fi passwords or other private information;
- properties the Owner is not entitled to rent, or any activity other than renting the Owner’s properties.
The Owner may not try to bypass the Service’s protections, overload it, or use it for another website than the one created in their account.
Anyone can report content on a website created with the Service by writing to hello@nowistay.com and giving: the reasons for the report, the exact address of the content (URL), their name and e-mail address, and a statement that they believe in good faith that the information is accurate.
The Platform acknowledges receipt of the report, examines it diligently and informs its author of its decision. When content appears illegal or contrary to these terms, the Platform may remove it or suspend the website or its preview. The Platform then informs the Owner of its decision and the reasons for it (statement of reasons), and of how to contest it. The Owner can reply by writing to the same address; the Platform restores the website when the reasons no longer apply.
The Platform may also suspend a website without prior notice when this is needed to stop a serious and obvious infringement or to protect guests, other Owners or the Service.
For the personal data of the website’s visitors (for example a booking request or a contact message), the Owner and the Platform act as described in the GTCU and the privacy policy. The Owner tells their visitors, in the website’s privacy page, how their data is used.
The Platform provides the Service with reasonable care and skill, without guaranteeing uninterrupted availability. It does not guarantee a number of visitors, a position in search results or a number of bookings.
The Owner is solely responsible for the content of their website and for their relationship with their guests. Within the limits allowed by law, the Platform’s liability for the Service is limited as provided in the GTCU.
These terms apply as long as the Owner has a website in their account. The Owner can delete a website that is not published at any time from their account. The removal of a published website follows the terms of the website subscription, offered separately. Deleting the account deletes its websites as described in the GTCU and the privacy policy.
These terms carry a version number. The Owner accepts the version in force when creating a website. When the Platform publishes a new version, the Owner is asked to accept it before continuing to use the Service; until then, the Owner’s existing websites stay online under the previous version.
These terms are governed by French law. Jurisdiction follows section 16 of the GTCU.
